General Terms and Conditions

These Terms and Conditions outline the rules and regulations governing the provision of recruitment and placement services.

1. Services Provided

The service provider will source and recruit suitable candidates as per the client's requirements. The process includes:

  • Identifying and screening candidates.
  • Coordinating interviews with the client.
  • Facilitating offer negotiations and placement.

2. Placement Fees

The client agrees to pay the placement fees based on the following structure:

  • 100% of the candidate’s monthly salary as the placement fee.
  • Placement fees apply only upon a successful offer and acceptance.
  • Monthly salary includes fixed salary and allowances.
  • Annual salary includes fixed salary, guaranteed bonuses, AWS, and allowances.

3. Replacement Warranty

If the placed candidate is terminated or resigns within the guarantee period, the service provider will offer a replacement, subject to:

  • The candidate was not previously hired under the replacement warranty.
  • The client has made payment within the due date.
  • The client informs the provider in writing within 7 working days of termination.
  • The client has made efforts to integrate the candidate into the workplace.

The provider will have 45 days to find a replacement. If a replacement is not found or the client opts out, a 50% refund will be issued after deducting administrative costs (e.g., medical fees, work pass application fees).

For more than one replacement, an administrative fee of $500 per successful replacement applies.

4. Payment Terms

Payments must be made within 30 days of the invoice date. Invoices will be issued upon:

  • Signing of the appointment letter, or
  • The candidate's commencement date (whichever is earlier).

Late payments are subject to a 1% monthly interest charge.

5. Limitation of Liability

The service provider ensures due diligence in selecting candidates but is not responsible for:

  • Any losses, damages, or delays resulting from candidate behavior.
  • The conduct of placed candidates at any time.

6. Confidentiality

All candidate information is strictly confidential, and candidates remain the property of the provider for 12 months from the introduction date.

If the client hires a candidate within this period (directly or via related entities), the full placement fee is applicable.

7. Validity and Termination

These Terms of Business (TOB) remain valid for one (1) year from the client's signature date unless terminated by either party with 30 days' written notice.

An interview with any introduced candidate is considered acceptance of these terms.
